    This grant to apparent land speculator Henry Walker was in northern Virginia near the Maryland border. However, Walker could have purchased these headrights from, say, a ship captain, in order to obtain this land grant. So the individuals mentioned may have simply sold their headrights to Walker and were not necessarily indentured servants to him, nor did they necessarily reside in Stafford County.

    So this record has been assigned for the time being to Joseph Daniel of Nansemond / Chowan, as he seems to be the only known and likely candidate.1

  • Biography*: 31 December 2005; Joseph Daniel probably came to Virginia some time prior to 1677.

    In 1714 he was granted land in Nansemond County, Virginia, the land was eventually part of Chowan County, and then Gates County, North Carolina.

    JOSEPH DANIEL, 205 acres (New Land) Upper Parish of Nansemond County; on West side of the Honey Pot Swamp; adjacent Colonel Baker; on Bennett’s Creek; 16 Dec 1714, Land Office Patents No. 10, 1710-1719, p. 204.
    Importation of four persons: Abigail Fitzgarrell, Dinah Milour, William Oagle, James Watkinson.

    According to The North Carolina Gazetteer, by William S. Powell, Honey Pot Swamp “rises in central Gates County and flows into Bennett’s Creek. Gates was formed in 1779, and most of the land had been Chowan County prior to 1759, so this grant was indeed in Chowan County, NC. And we know that Simon Daniel, son of JOSEPH, was on Bennett’s Creek, due to the petition he signed at some date after 1734.

    In 1728 Richard Odam disputed Joseph Daniel's Virginia patent to land on Honey Pot Swamp, but no copy of his requested North Carolina patent has been found in Margaret Hofmann's "Province of North Carolina 1663 - 1729 Abstracts of Land Patents. This would suggest that Richard Odam's petition, which follows, was rejected, or that the record of the subsequent patent has been lost.

    The Colonial Records of NC (second series) Vol. VII Records of The Executive Council 1664-1734: 6 Aug 1728 Read the Petition of Richard ODAM Shewing that in the year 1704 he Entered four hundred acres of Land on the Honey Pot Swamp as by a Copy of said entry appears, and that Joseph DANIEL Knoeing the said Entry procured as Virginia Survey and patent for the same Land calling it Two hundred and five acres altho this said Land then and now is part of this Province [Chowan Precinct] Praying a Caveat may be Entered against the said Josph DANIELS obtaining a Patent for the said Land and that he be permitted to proceed and Survey his entry and Patent the same.
    
    Thereupon it is ordered that Summons Issue to the Partied requiring them to Attend next Board.

    Carroll ~ Case against Cook
    25 May 1724. Thomas Hamond Jr late of Virginia & Thomas Parris of Edenton in Chowan Precinct give their bond to Christopher Gale Chief Justice in the sum of £250. The condition of the bond was that sd Thomas Hammond Jr, who had commenced an action on behalf of James & Daniel Carroll executors of Charles Carroll dec’d, against Thomas Cook for £150 sterling to be heard at General Court at Edenton the last in Jul next, would pay the costs & damages should he fail to prosecute the sd suit. Wit: W. Badham, Clement Hammond. Onback: Ann Vann age 78 testified that she knew Joseph Daniel dec’d late of Nansmond Co VA & that he now has 3 living Sons & 1 daughter, namely, Joseph, Simon, & William Daniel the sons & [blank]

    Since Joseph Daniel was deceased, Ann Vann's testimony was needed to establish the names of his sons.
    Ann Vann was perhaps related to the William Vann (Vaun) of Nansemond County, whose patent date, 16 Dec 1714, is the same date as Joseph Daniel's patent there: William Vaun (Vann); 130 acres (New Land), Upper Parish of Nansemond County; at a place called Starrum (Sarum Creek, now called Coles Creek, in present day Gates County, NC); adjacent Peter Phebus; & Charles Scott's line; 16 December 1714, page 203, Land Office Patents No. 10, 1710-1719; Import of three persons: Patrick Lawler, Eliza.     William Vann left records in the Bennett's Creek area of Chowan (later Gates) County until his death there in 1740.

    It it not clear whether Ann was perhaps an unmarried sister of William Vann, or whether she was a sister of Joseph Daniel, married to an unnamed Vann, etc. At the time, she was considered a suffiently reliable witness to have her testimony heard in court, to establish the relationship between Joseph Daniel and his three sons, Joseph, William, and Simon. The original documents relating to this case should be checked for further clues, including the will and estate records of Charles Carroll, deceased.

    I can't honestly say who Ann Vann was. William Vann of the 1740 will had a daughter Ann, but she would have presumably been too young to be the 78 year old Ann that professed to knowing Joseph & sons in 1724. The name Anne appears in Vann family records in future generations. We also know the Vanns, like Simon, were involved in the forest products industry (more specifically the manufacture of pine tar presumably for marine purposes). Therefore they were also located in the Bennetts Creek area which was an apparent hotbed for the tar business. Numerous records tie the Daniel family (Simon & William) to the Vanns:
    21 Oct 1743 Edward VANN son of Wm. VANN appointed constable in the place of William DANIEL.
    Jul 1737 Ordered that Wm. DANIEL be overseer in the room of Jos. Van.
    Jan 1737 Orderd that the following persons be appointed as a Jury to Lay out ye Roads from Bennets Creek Bridge to Meherrin Ferry (Vizt) Henry GUSTON, Jno. Vann, Thos.   • Research Note*: 2 January 2006; The only other currently known Joseph Daniel, other than the one of Nansemond / Chowan, was Joseph, probable son of James, who left a will in Prince George County, VA in 1712.

    Here is Payne Daniel's account of this other Joseph and his family. Perhaps they were related to Joseph of Nansemond / Chowan. If so, the common ancestor might have been Roger Daniel, the immigrant, or even a connection to a more distant branch of Roger's family in England.

    From Payne Daniel:

    THE JOSEPH DANIEL OF PRINCE GEORGE COUNTY VIRGINIA

    Joseph DANIELL died September of 1712 PGC- brother of Thomas and married
    to Elizabeth. Joseph Daniel paid quit rents on 1704 acres in 1704. He died
    soon after his brother Thomas (will dated 3 Jan. 1711/2 page 158 ,
    recorded 9 Sept. 1712 ). His will, that he marked with a "D," identified his
    wife as Elizabeth and left property to four sons and a daughter, Joseph,
    Roger, Thomas, John, and Elizabeth.

    Elizabeth may have been Elizabeth Reese since they named a son, Roger
    Daniel.

    i. Joseph Daniell born abt 1690 - was executor of his father's
    will.

    ii. Rogger Daniell born abt 1692 - purchase property from William
    Rives in 1759 with John Daniel.

    iii. John Daniell born abt 1694 - Pritchett suggest that this John
    may be the Dr. John Daniel __c.1756, who appears briefly in Brunswick County
    and was the father of Reese Daniel. It is unlikely that this John is the one
    we call John Daniel of St. Andrews Parish who was born about 1707 or later.

    iv. Thomas Daniell born abt 1700/1710 - was underage when his father
    made his will.

    v. Elizabeth born abt 1696 - It has been suggested that she
    shows up in Brunswick County, Virginia in 1731, perhaps following her
    brother John.

    Regarding James Daniel, the father of this Joseph Daniel (who was NOT the Joseph of Nansemond / Chowan)
    Payne Daniel adds:

    Let me make an assumption. James Daniel, born
    about 1660 and married to Elizabeth Drury in 1683, was the son of Roger
    Daniell Jr., of Warwick County, Virginia. They had the following children:
    1. William Daniel (had to be born after 1683), 2. Joseph Daniel (had to be
    born after 1683), 3. Drury Daniel, 4. James Daniel, and 5. Elizabeth Daniel
    born about 1704. Now, the William Daniel who left a will in Brunswick County
    in 1786, who and was born about 1736, could not be the William the son of
    James? Also, the Joseph Daniel of Brunswick who was born about 1750 and died
    in 1792, could not be the son of James? I can buy that Elizabeth born in
    1704 was probably the daughter of James and she may have had brothers
    William, James, Drury, and Joseph. I believe that Ray was incorrect in his
    assignment of the William d. 1786, and Joseph d. 1792/3, to James Daniel of
    Warwick County, Virginia.

    Mr. Ray stated that James Daniel, son of Roger Daniell Jr., may have been
    the progenitor of the some of the Brunswick Daniel families. This may be an
    incorrect assumption since James would be about the same age as the
    "brothers and sisters" of Prince George County, Virginia? There was
    doubtless a connection between the Prince George County and Brunswick County

    It is more likely that William and Joseph Daniel (some of William's bunch
    went off to Rowan County) were the issue of John Daniel and Ann Armon Wright
    as was proposed by Charles Heinemann. Why did Ray and Heinemann disagree on
    theses assignments; who knows?"3

  • Research Note*: I offer Simon Daniel (Symon Daniell) as a possible father or brother of Joseph Daniel, for speculative purposes only, and in the interest of furthering discussion.

    Obviously, the name Simon is a useful clue, and conforms to the later family, but proof of any connection is lacking at the moment. No Warwick County, VA records, or any other VA records, have yet been checked for this early Simon Daniel. All we have on him is the following:

    Charles Blankeville (Bankevile), 400 acres Warwick County, 8 May 1673, page 450 of Patent Book 6, Neare James River adjacent to Mr. Stratton's land in tenure of Mr. Thomas Merry; land of SYMON DANIELLS' orphan, in possession of John Jackson; etc. Said land formerly in possession of Henry Moore, whose relict he married; & for transport of nine persons (not named).

    From Lew Griffin: This Joseph Winslow was probably the Joseph Winslow (1642 - ca. 1679) of Plymouth, MA (Mayflower descendant), son of John Winslow and Mary Chilton. He was probably the ancestor of the Winslow family of early Perquimans County, NC. There was an active commerce between early NC and early MA, and some early NC lines can be traced back to Massachusetts, and vice versa, through this trade connection. Certain Quakers who were expelled from MA also came to early NC. A little information on the early NC Winslow family can be found elsewhere in this file.1

  • Biography*: There were two contemporary John Phillips, one who lived in Richmond County GA and one who lived in Wilkes County, GA. I believe these two different John Phillips have been confused.

    There was a John Phillips who patented land in St. Paul and St. George Parishes from 1762 to 1771. This was probably the John Phillips married to Ruth Beall who lived and died in Richmond County, because Richmond County was carved out of St. Paul and St. George Parishes. Wilkes County was not.

    On 27 Sept 1773, Joel Phillips, Zach Phillips and John Phillips all applied for patents in Wilkes County, GA. It is likely that these three men were related, because a Joseph Maddock served as security for all three of them. William and Harriet Horn Phillips supposedly had sons named Joel, Zachariah and John, and I suspect that they were these three men.

    On 1 July 1777, John Phillips, Zachariah Phillips and Joel Phillips, all of Wilkes County GA, signed a petition protesting the behavior of General McIntosh who had been appointed Brigadier General in the Continental Army. Note that this is the same year that John Phillips of Richmond County GA wrote his will and subsequently died. His wife Ruth qualified as an Executor in August of 1777. In 1781, William Philips was appointed administrator of the estate of his father, John Phillips, deceased, in Wilkes County, GA.1
