  • Note*: December 1929; James Stewart first appears in Rowan county, N. C., in 1744, when he was granted by John, earl of Granville, a tract of 500 acres on Third Creek and Stewart branch, the fee being three shillings sterling for over 100 acres and ten shillings for the rest; recorded at Salisbury. Rowan county at that time was very large and primitive, occupying nearly the whold western part of the province. James Stewart may have come from Lancaster county, Pa. [see Tribe of Lazarus Stewart, B:84]. The land he acquired lay on creeks along the west side of the river Yadkin, in what is still Rowan county.

    He was granted three tracts in 1759 -- 610 acres and 600 acres on Third creek and [South] Yadkin river and 500 acres on Third Creek and Stewart branch ( which may have been a confirmation of the grant 15 years before).

    Jan. 22, 1761, he was granted 619 acres situated on Withers creek, and in 1762 he was deeded 350 and 530 acres by the earl of Granville and Thomas Douglas and wife Jannet.

    He was probably the James Stewart of Rowan county who made his will Oct. 2, 1778, which was probably probated in 1779. [Salisbury, C: 204]. He made his son Matthew executor, and the witnesses were John Bradley, James Hughs and John McNeely, jr.

    He gave his wife Elizabeth all his hard money, yarn, cloth, iron pot, griddle, pewter and wooden ware, fine brass hackle, sheep, two beds, "her furniture, also her spinning wheel and clock and reel and all her wearing apparel, one horse and two cows, such as she shall choose out of my stock of horses and cattle, all these to be solely at her own disposal except the horse I allow to return to my son Matthew after her decease.

    He also made bequests to his son-in-law John Woods, granddaughter Elinor Wood when 18, son-in-law Thomas Thomson, and grandson James Thomson when 21.

    To his Matthew he gave all the rest of his goods and chattels, lands and tenements, and charged him with the care of "his aged mother."

    Elizabeth dated her will Nov. 7, 1792 [Salisbury, D:65], making her son Matthew executor and allowing him "to keep the price of the black mare of mine which he sold to James Cowan." and making gifts to Matthew's son William and daughter Mary Stewart and wife Elizabeth. She mentioned her granddaughters Elizabeth Thomson, Mary Thomson, Pamelia Thomson, Adnes McKnight, Eleanor Woods, Mary Stewart and Agnes Stewart. Robert Cowan and William Cowan were jurors.

  • Note: January 1939; James Stewart of Rowan county received May 6, 1758, from John, earl of Granville, a grant of 501 acres on Third creek, on a branch callled Stewart's branch, adjoining lands of John McIlrath and Capt. John Kerr: proved May 24, 1758, by the oath of Thomas Gillespie. Stewart sold this tract May 24, 1758, to John Knox, great-grandfather of President James Knox Polk.

    He then got a grant Feb. 22, 1759, from Lord Granville of 640 acres on the south side of Third Creek, opposite Capt. John Kerr's land, which may have been re-granted in 1779. In this grant James was called yeoman.

    James bought Mar. 3, 1762, of Thomas Douglas 350 acre of land lying on both sides of Withrow creek, adjoining his own land, and the next day he received a deed from Douglas of 530 acres adjoining, witnessed by William McNary and Samuel Young.

    Aug 6, 1765, James Stewart, gentleman, and wife Elizabeth sold to Adam McNeely the two tracts (350+530=880), 880 acres which they had bought of Thomas Douglas.

    Jan 8, 1765, James Stewart, weaver, bought of Matthew Gillespie 136 acres on both sides of the east fork of Cathey's mill creek.

    James was granted July 1, 1779, 640 acres on the waters of Thompson's mill creek (formerly Cathey's mill creek), joining his deeded land and crossing four drafts of the mill creek: entered May 27, 1778.

    His son Matthew sold these tracts Aug. 2, 1790, to Frederick Sickles (136+640=776) 776 acres on the east fork of Thompson's mill creek, Andrew McCollum's corner.

    James dated his will Oct. 2, 1778, and it was witnessed by John Braley, James Hughes and John McNeely, jr. [wills, C: 204]. He mentioned his wife Elizabeth; son Matthew, executor; son-in-law John Woods; granddaughter Eleanor Woods, when 18; son-in-law Thomas Thompson; and grandson James Thompson.

    If his will was probated in 1779, as supposed, he was not James, son of Lazarus. But as his will was recorded on page 204, and William's will, dated in 1781, was recorded on page 186 of the same book, we believe James died after 1781. [But it would have to have been after 1784 for him to have been the son of Lazarus, which he was not -- Lew Griffin]

    Elizabeth dated her will Nov. 7, 1792, and it was witnessed by Robert Cowan and William Cowan, jr. [wills, D: 65]. She mentioned her son Matthew, executor, Matthew's wife Elizabeth and his children William and Mary, and granddaughters Elizabeth Thompson, Mary Thompson, Agnes McKnight, Pamel Thompson, Eleanor Woods and Agnes Stewart.

    We looked for Stewart gravestones in the old Third Creek Presbyterian church yard, but found none. The old Scotch were not much for gravestones. They made cairns all over Scotland, and many great men lie under those nameless pious heaps of stones....

    James probably had other children:

John Steuart of Donegal

  • Note*: February 1937; John Stewart is mentioned in the History of Lancaster County as being a settler along Chickies creek in Donegal township in 1717 with George Stewart [Tome C, p. 211]. This John Stewart could hardly have been George's son, who was then probably a boy of not over ten years of age, but was in all probability George's brother.

    Among settlers in 1718 were the Galbraith brothers -- Andrew, James and John. Andrew Galbraith settled below Donegal church, on land later owned by Peter Nisley and the Garbers. Mountjoy township was formed from Donegal about 1755. Jacob Nisley was and original settler in Mountjoy, say Evans & Ellis's history, and had two sons and three daughters -- John, who married a Sechrist; Martin, who married a Snyder; a daughter who married a Burman; a daughter who married an Ebersole; and a daughter who married a Steward. Rapho township was formed in 1741. One of the oldest buildings in this township was on a farm then [1883] owned by Jacob W. Snyder, formerly Martin Nisley's. We do not know the history of this John Stewart, but he may have been the father of John of Mountjoy who is said to have married Elizabeth Snyder [Tome B: 94].

    Matthew Stewart of Jefferson county, Ky., died late in 1823 or early in 1824, as his will, dated Sep. 18, 1823, was offered for probate Feb. 9, 1824, by his sons Hugh and William. The probate was contested, however, by a son-in-law, William Woods, who had been given only $5, as had been the other son-in-law, Joseph Gheen, while the two sons had been given the plantation, and the daughter Sally Woods had received a slave girl and several other things, and the contest was not settled until Apr. 12, 1824....2
  • Note*: January 1939; Matthew Stewart married about 1779 Elizabeth Jenkins. Aug 15, 1784, he bought of William Cowan 426 acres on the north side of Second creek, joining Henry Robertson and David Cowan's land, it being the plantation whereon William Cowan then lived, bounded by Malcolm Hamilton's (then Abraham Gilliban's), which Cowan had bought of Moses Thompson.

    Aug 2, 1790, Matthew sold two tracts of land on Thompson's mill creek, which he evidently inherited from his father. In the census of 1790 he was listed as 1-2-4.

    Sep 13, 1808, Matthew Stewart, planter, of Rowan county and wife Elizabeth sold to Francis Neely, esq., for $1600, 446 acres on the north side of ?Second creek, on Gilliban's and Cowan's corners. He afterwards moved to Jefferson county, Ky., Tome C: 150.

  • Note*: January 1939; James Stewart (son of Thomas, son of Archibald) of Augusta county, Va., married, about 1773, Elizabeth Montgomery, daughter of Hugh Montgomery. Hugh Montgomery of Salisbury made his will Dec. 16, 1779, naming as executors James Kerr, the elder, of Salisbury, David Nesbitt of Salisbury and John Brown of Wilkes county [wills, E:41]. He gave his son Hugh, then a minor, "my large plantation on New river in the state of Virginia, which I hitherto purchased from one Calhoun"; to his daughter Jane, under 21 and unmarried, the land on New river "which I heretofore purchased from widow Noble's son"'; to his son-in-law Dr. Anthony Newnan his country home on Grant creek near Salisbury; to his grandson Hugh Blake land on Second creek; to his daughter Elizabeth Steward £20 and no more; to her eldest daughter and eldest son each a negro boy; and to his daughter Nancy Ingram £20 and no more: the will was proved at the February court, 1780. Hugh Montgomery died Dec. 23, 1779, as we found from a gravestone under an ancient cypress tree in the "old English" cemetery in Salisbury. He was a wealthy citizen, said Rumple's History of Rowan County, 1881, who owned much land in Wilkes county: he lived in the old Yarboro house, then standing (in Revolutionary days) upon the site of Meroney's hall.

    Daniel Clary and Hugh Montgomery (the younger) of Rowan county deeded Aug 9, 1792, to James Stewart of Washington county, N. C. [now Tennessee], 450 acres on the headwaters of Coldwater, joining to John Campbell and John Graham's lands, in Rowan county, and James sold this tract Mar. 15, 1798, to John Newnan, the witnesses being Hugh Newman and Thomas Stewart.
