  • Biography*: EDWARD BARNES, died in the Spring of 1761 in Edgecombe County, N. C.. He married SARAH.

    On April 28, 1711, Edward Barnes patented 131 acres east of Chowan River in Nansemond County (3.).

    On April 6, 1722, he patented 340 acres west of the head of Chowan River and south of Indian Creek Swamp in Chowan County (4.). On March 26, 1723, he and Richard Holland patented 460 acres west of Chowan River and west of Mirey Meadow adjoining Joseph Ballard, John Gay, John Davison and Godfrey Lee (5.). On August 1, 1727 he patented 540 acres west of Chowan River and south of Indian River, west of Mirey Marsh and along Mirey Meadow (7.). On August 11,1727, he patented 575 acres west of Chowan River "known by the name of the Nansemond town" and south of Indian Creek (8.). (The preceding patents totaled 2,161 acres of land). On October 27, 1726, the name of Edward Barnes was mentioned in connection with land grants on lapsed patents (9.).

    On June 12, 1735 he paid arrears of Quit Rents from September 1729 to March 1732, in the amount of 17 pounds, 6.6 shillings, on 440 acres in Bertie County, N.C. (10.). On May 18, 1738, he witnessed the will of John Baude in Bertie County (11.).

    On February 1, 1741/42 John Minsie of Chowan County sold Edward Barnes of Northampton County for 20 pounds Virginia money 440 acres (from a patent of 640 acres dated April 1, 1723) north of Indian Creek Swamp, west of Chowan River, and along John Hooks, the Virginia line, Meadow branch and Robert Braswell (the other 200 acres had been sold to Bryan MacClain); witnessed by Robert Sharman and James Maney (12.). On February 6, 1741/42, Edward (EB) Barnes and James Maney witnessed the deed of Robert Sharman to George Liverman in Bertie County. (13.). On August 12,1742, Edward (E) Barnes, Yeoman, of Northampton County, deeded to "my beloved son Wm. Barnes," 150 acres west of the head of Chowan River and south of Indian Creek Swamp; witnessed by Peter Garland, Thomas Best and Barret Montgomery, (14.). On September 15, 1743, Edward (E) Barnes, Planter of Northampton County, sold to James Many, Merchant, for 10 pounds current money of Virginia 100 acres west of Chowan River and west of Indian Creek Swamp (from my patent of May 2, 1725); witnessed by William Barnes, John (P) Page and Robert Tharpe, (15.).

    On May 12, 1747, Edward (EB) Barnes of "Edgecombe" sold Carr Durden of Nansemond for 28 pounds and 8 shillings current Virginia money, 440 acres in Northampton County north of Indian Creek Swamp adjoining the Virginia line (part of a patent to John Mensie on April 1, 1723); witnessed by Elisha (E) Durden and Joseph Barnes, (16.). On January 22, 1747/48, Edward (E) Barnes sold James Maney for 10 pounds current Virginia money 100 acres on Horse Pasture Branch; witnessed by Joseph Barnes and Thomas Uzzell (17.). On June 16, 1752, Edward Barnes made an unsuccessful attempt to patent 300 acres north of Toisnot Swamp in Edgecombe County (18). On October 25, 1753 he patented 179 acres adjoining the land of John Thomas in Edgecombe County, (19.). On June 24, 1761, in the Edgecombe County Court of Pleas and Quarter Sessions, "Ordered that Edward Barnes an old and infirm Person be exempted from paying County Taxes and that He be recommended to the Next Assembly for a further Exemption of Public taxes, (20.). Edward Barnes had lived after 1722 near the present Riddicksville in the extreme northeastern corner of Northampton County, an area included in Bertie County from 1722 to 1741. He appears to have settled near the White Oak Swamp in Edgecombe (now Wilson) County in 1753.

    Edward (B) Barnes made his Will in St. Mary's Parish of Edgecombe County on December 15, 1760, describing himself as a Planter "formerly of Chowan River," and it was probated on March 23, 1762. In his Will he left: to son Nathan Barnes, one shilling; son William Barnes one shilling; son Jacob Barnes, one shilling; son Abraham Barnes, one shilling; daughter Mourning Fiveash, one shilling; daughter Charity Simms, one shilling; daughter Elizabeth Leigh, one shilling; daughter Sarah Amason, one shilling; daughter Patience Barnes, 100 acres on Chowan River, where she was then living, after the death of her mother; grandson Jacob Barnes, reversional interest in the 100 acres on Chowan River, after the death of Patience Barnes; granddaughter Barbara Wiggins, two cows; granddaughter Ferreby Wiggins, two cows; grandson Michael Barnes, the tract called Mirey Marsh on Chowan River where his mother was then living. wife Sarah Barnes, lifetime use of the land where Patience Barnes was living: Witnesses James Barfield, Eliza Barfield, and Thomas Edmundson (21.).

  • Biography*: This writer's records on William Daniel in early Edgecombe are far from conclusive. It is possible that there wre two or more Williams. At least, there may have been a William, son of Simon Daniel I of Chowan. And apparently, a second William, son of Simon II who died in 1763 in Edgecombe. And a third William, son of Simon III who ended up in SC.

    Records also suggest that a William Daniel may have married Sarah Willis, daughter of the William Willis who died in Edgecombe Co, NC in 1776. A William Daniel seems to have been closely associated with William Willis in Edgecombe County records. Further research is needed.

  • Biography*: The first Simon Daniel of Chowan Precinct NC was probably born around 1678 - 1685.

    7 Feb 1700 Mathew PRICHARD & Frances TOMES give their bond to the Lords Proprietors. The condition of the bond is that said Mathew PRITCHARD obtained administration of Patrick HENLEY dec'd & will properly administer the estate. Witnessed by Samuel SWANN, SIMON DANIEL. (Colonial Estates of NC) Simon would have to have been at least 14 years old to witness a deed, and so was born no later than 1686.

    Simon Daniel was probably no more than 23 years old, and possibly much younger, when in 1701, he witnessed the deed of Joshua Lamb of Roxborough, County of Suffolk, MA, to Samuel Swann, for 300 acres on the NE side of the Perquimans River adjacent to Timothy Clare and John Lawrence (Perquimans Deed Bk A:172). Was Simon related to any of these individuals? And what was he doing in Perquimans? Did his occupation at that time require travel? Was he a farm laborer? A peddler? A minister? A school teacher?

    Then follows a long gap in which no records on Simon have been found. He does not, for instance, appear in surviving NC Land Patent records. No further record of him has been found until the following 1723 deed in Chowan County:

    John JORNAGEN by William LITTLE his Attorney comes to prosecute his Suite (sic) against Robert ROGERS late of Virginia but now of North Carolina planter and Simon DANIELL of the Same province planter in custody etc. of a plea for that to witt in the precinct of Chowan on or about the seventeenth of January One thousand Seven hundred and twenty five the Defendante's by force and Armes etc, did enter into and upon the Lands and posession of the plaintiffe and him the Sayd plaintiffe dud then and there assault batter bruise wound and evilly intreat and also a Tarr Kiln of Light Wood by the sayd plaintiffe gather'd logg'd and [tars't] ready for burning of and to the plaintiffe belonging then and there did by force and Armes etc. Seize and take posession of and burne the Same into Tarr and the said Tarr amounting to Sixty two barrells to the plaintiffe belonging they the Defentante's (sic) then and there took and carried away against the peace of Our Sovereign Lord the King and to the damage of the plaintiffe One hundred pounds and therfore he brings this Suite etc. And the said Robert <115> ROGERS by David Osheall his Attorney prayeth License to imparle untill the next Court on the last Tuesday in July next to answer to the plea of the plaintiife aforesayd and he hath it the Same day is given to the Plaintiffe. And the sayd Simon DANIELL (tho' Solemly required) came not and the returne of the Writt being (not to be found) At the plaintiffes's Motion It is Order'd that an alias Should issue.

Decd. dated 17 Apl 1694, beginning at the mouth of a branch yt. runs out of the Swamp called MILLSES Swamp & running up said swamp to the beginning of the patent to a markd Hickery in or near the mouth up a branch then running up the branch along the patent line to the upper corner tree of the patent a White Oak then along the side line of the patent to a White Oak standing in or near the sd. pattent line yn. down a small branch by a line of markd trees in or by the sd branch to a Gum standing in or near the sd swamp at the first begining...Wit: SIMON DANIEL, Wm.     Note that Simon does not sign with a mark, assuming the transcript is correct, and so he was apparently literate. Given his absence from deed records, it may be that he was following some occupation other than farming. In any case, the long lapse in records on him is troubling. It might even suggest that when the name Simon does suddenly show up again in records, in the 1740's, that it was not this first Simon, but perhaps a son. It is possible that this Simon, thought to be the son of Joseph Daniel, died in Chowan. And that the Simon who died in 1763 in Edgecombe was actually his son, Simon II. If Simon I was born no later than 1685, and lived no longer than the average age of 45 to 50, then he could easily have died quietly in Chowan County in the 1730's or 1740's. And if he was a minister, a merchant, a blacksmith, etc., and did not own land, then chances are he would have left no probate records.

    "Humbly Sheweth To the Worshipfull Bench of Justices Sitting at Edenton, The humble Petition of the Upper Inhabitants of Chowan County, That your petitioners humbly apprehending that there is an order Granted out of this Court for a new Road to be made from Bennetts Creek Road to Pughs Causey, being full twelve Miles, And We humbly beg leave to acquaint your Worships of the Difficulty in doing of it, and the unusefulness when done, being not convenient for the Inhabitants other to Church Mill and Market, There is Coles Creek so bad and Rotten and freshes arising Renders it morally Impossible for a Bridge to stand, Besides Six Intolerable Swamps and many other troublesome places and this making of this new Road only shortens four miles from the old Road that has been laid out by two Jurys, and twenty men will make the old Road good with more case, than two hundred men this new one. And We further beg leave to acquaint your Worships, That We humbly apprehend that the Promoters of this new Road has Imposed upon you, by getting a Jury to buy out this Road, that are not Inhabitants to work upon this Road (Except one) Which We imagine to be contrary to Law and Custom.     The above petition is not the original, and was transcribed into the order book by a clerk. Hence it does not contain any original signatures. Also, this writer is under the impression that the very early Edgecombe deed books deteriorated and were at some point re-copied, and what we have now are just those copies. So chances are that it is not going to be possible to obtain original signatures from early Edgecombe County deeds, either.
    .
    For the purposes of research and discussion, this writer is going to make some assumptions. I'm guessing that it was this first Simon Daniel who married Elizabeth Rogers, daughter of Robert Rogers. And I'm speculating that this first Simon died in Chowan or Bertie, or early Edgecombe Precinct, and left no estate or record of his death. .
    And for the purposes of speculation, I'm wondering if that his children might have included: 1) the Simon Daniel who died in 1763 in Edgecombe: 2) Joseph Daniel who died in 1800 in Edgecombe; 3) the William Daniel who died in 1789 in Edgecombe; 4) the Robert Daniel who died in Martin County in the 1780's; 5) Hardy Daniel who died in the 1760's in Edgecombe.

    And I'm speculating that 1) the first Simon, possible son of Joseph Daniel, married Elizabeth Rogers; 2) Simon's son Simon II married Elizabeth Bentley; and 3) Simon II's son Simon III married a Pettypool, daughter of Stephen Pettypool.

    Additional evidence either for or against the above speculation will be appreciated.

    John JORNAGEN by William LITTLE his Attorney comes to prosecute his Suite (sic) against Robert ROGERS late of Virginia but now of North Carolina planter and Simon DANIELL of the Same province planter in custody etc. of a plea for that to witt in the precinct of Chowan on or about the seventeenth of January One thousand Seven hundred and twenty five the Defendante's by force and Armes etc, did enter into and upon the Lands and posession of the plaintiffe and him the Sayd plaintiffe dud then and there assault batter bruise wound and evilly intreat and also a Tarr Kiln of Light Wood by the sayd plaintiffe gather'd logg'd and [tars't] ready for burning of and to the plaintiffe belonging then and there did by force and Armes etc. Seize and take posession of and burne the Same into Tarr and the said Tarr amounting to Sixty two barrells to the plaintiffe belonging they the Defentante's (sic) then and there took and carried away against the peace of Our Sovereign Lord the King and to the damage of the plaintiffe One hundred pounds and therfore he brings this Suite etc. And the said Robert <115> ROGERS by David Osheall his Attorney prayeth License to imparle untill the next Court on the last Tuesday in July next to answer to the plea of the plaintiife aforesayd and he hath it the Same day is given to the Plaintiffe.
